Governor DeSantis Temporary Order on Foreclosures and Evictions
Governor DeSantis has provided Florida residents with temporary relief from residential foreclosures and residential tenant evictions due to non-payment of rent. A temporary order was issued on April 2, 2020, to be effective immediately for 45 days. So, basically, all foreclosure and eviction actions that could have been filed on April 2, 2020, are now forced on hold for 45 days. So, for those looking at potential foreclosure or eviction actions, they have been given extra time before they can be forced out of their homes.
However, it is very important to understand that the obligation to pay your mortgage and rent payments is not excused during this time period. You should not assume that this Order will save you from eventually being foreclosed or evicted if you do not pay your mortgage or rent pursuant to your contract. If you are unable to pay your rent or mortgage due to losing your income during the COVID-19 Pandemic, you should contact your landlord or mortgage holder and attempt to work out a payment plan. Do not rely on this Order as permission to not pay your mortgage or rent.
